Programme Synopsis

The timely release of the decision of the Hong Kong Court of Final Appeal in the case of Zhang Hong Li v. DBS provided trustees with some relief - the anti-Bartlett clauses still provided trustees with protection in settlor reserved trusts or trusts where investments are driven by investment committees. Or does it? We take this opportunity to review the decision against the other cases before the Singapore courts, provide an update of decisions in Singapore that may affect trusts and trustees and discuss the options of trustees when they are faced with litigation - should trustees prepare for litigation or retire?
